  • Does Becoming President Halt Criminal Trials? Debate Heats Up Over Constitutional Immunity

Jee,hyungduk;Sisaknews Reporter

A heated legal and political debate has emerged in South Korea over whether a sitting president can be subject to ongoing criminal trials, despite a constitutional clause that prevents prosecution while in office.

At the center of the controversy is Article 84 of the Constitution, which states: “The President shall not be subject to criminal prosecution during their term of office, except in cases of insurrection or treason.”

Legal Immunity - But How Far Does It Go?

The clause is widely interpreted to mean that a president cannot be indicted or newly prosecuted while in office. However, debate has intensified over whether this protection also extends to ongoing trials for indictments made before assuming the presidency.

During the recent election campaign, the now-elected president was facing five separate criminal cases, including charges related to election law violations. Some legal scholars and opposition lawmakers argue that the trials should continue despite the president’s new status. However, the Democratic Partyclaims that all legal proceedings should be paused, citing constitutional immunity.

Legal Experts Push Back

Many in the legal community reject the idea that trials must be suspended. Former Korea Legal Aid Corporation head Lee Heonemphasized that the term “sochu”(prosecution) in Article 84 refers narrowly to indictment, not the entire judicial process.

“No constitutional text or commentary interprets prosecution as including trials,” said Lee. “Stopping trials would not only stretch the meaning of the Constitution but could also violate the principle of legal equality.”

Legislative Moves Fuel "Shield Law" Accusations

Amid the legal uncertainty, the Democratic Party has moved to introduce legislation that would explicitly halt criminal trials for sitting presidents. A proposed Criminal Procedure Act amendmentwould require courts to suspend proceedings against the president until the end of their term.

In addition, a proposed Public Official Election Act amendmentwould modify the legal basis for one of the charges the president is facing, potentially rendering it unenforceable.

Critics from both legal and political circles say the legislative push amounts to a “shield law”designed to protect one individual, warning that it could undermine constitutional checks and the rule of law.

What's at Stake?

At the heart of the issue is a broader question about the rule of law in South Korea: Should the president be above legal scrutiny while in office?

While some argue that immunity is necessary to protect the president’s ability to govern, others warn that halting trials could erode public trust in the legal system and damage the principle that no one is above the law.

As the bills move toward a National Assembly vote, legal scholars and civil society groups are calling for a balanced interpretationof the Constitution - one that protects presidential duties without creating impunity.
